Welcome to WikiMoi. These Terms and Conditions ("Terms") govern your access to and use of the WikiMoi website (wikimoi.com), mobile application, and related services (collectively, the "Service") operated by WikiMoi UG ("WikiMoi," "we," "us," or "our"), a company registered in Berlin, Germany. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

1. Acceptance of Terms

By creating an account, accessing, or using our Service, you confirm that you are at least 16 years of age and have the legal capacity to enter into this agreement. If you are accessing the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Account Registration and Security

• You may register using Google Sign-In or Apple Sign-In. You are responsible for maintaining the security of your authentication credentials.
• You are responsible for all activities that occur under your account.
• You must provide accurate and complete information during registration and keep your account information up to date.
• You must notify us immediately if you suspect any unauthorized use of your account.
• We reserve the right to suspend or terminate accounts that violate these Terms or that show signs of fraudulent activity.

3. User-Generated Content

3.1 Your Content

You retain ownership of the content you provide to WikiMoi, including the information you share during AI conversations and any media you upload. By submitting content to our Service, you grant WikiMoi a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content in connection with operating and providing the Service.

3.2 Content Responsibilities

You are solely responsible for the content you provide. You agree that your content will not:

• Be false, misleading, or fraudulent
• Infringe upon the intellectual property rights, privacy rights, or other rights of any third party
• Contain defamatory, libelous, or threatening material
• Contain hate speech, harassment, or discrimination based on race, ethnicity, gender, religion, sexual orientation, disability, or other protected characteristics
• Contain illegal content or promote illegal activities
• Contain malware, viruses, or other harmful code
• Impersonate another person or misrepresent your identity

3.3 Content Moderation

WikiMoi reserves the right to review, edit, or remove any content that violates these Terms or that we deem inappropriate, without prior notice. We may also implement automated content moderation tools to detect and prevent policy violations.

4. AI-Generated Content

WikiMoi uses artificial intelligence (powered by OpenAI) to generate biographical content based on the information you provide through guided conversations. You acknowledge and agree that:

• AI-generated content may not be perfectly accurate and should be reviewed by you before publication.
• You are responsible for reviewing and editing your AI-generated biography for accuracy and completeness.
• WikiMoi does not guarantee the accuracy, completeness, or quality of AI-generated content.
• AI-generated biographies are created based on the information you provide. The quality of the output depends on the quality and completeness of your input.
• You may edit, modify, or delete any AI-generated content on your profile at any time.

5. Intellectual Property

5.1 WikiMoi's Intellectual Property

The WikiMoi name, logo, website design, software, algorithms, and all associated intellectual property are owned by WikiMoi UG. You may not copy, modify, distribute, sell, or lease any part of our Service or included software without our written permission.

5.2 Trademarks

"WikiMoi" and the WikiMoi logo are trademarks of WikiMoi UG. You may not use our trademarks without our prior written consent, except as necessary to refer to our services in a factual manner.

6. Acceptable Use

You agree not to use the Service to:

• Create profiles for other individuals without their explicit consent
• Scrape, crawl, or use automated tools to access the Service in a manner that exceeds reasonable use
• Interfere with or disrupt the Service or its infrastructure
• Attempt to gain unauthorized access to other users' accounts or our systems
• Use the Service for any commercial purpose without our prior written consent
• Circumvent any technical measures we use to provide or protect the Service
• Use the Party Game feature to generate harassing or inappropriate questions about other users

7. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data. By using the Service, you acknowledge that you have read and understood our Privacy Policy.

8. Premium Services

WikiMoi may offer premium subscription features. By subscribing to a premium plan, you agree to pay the applicable fees. Premium features, pricing, and terms will be presented to you before purchase. Refund policies for premium services will be governed by applicable consumer protection laws.

9. Third-Party Services

The Service integrates with third-party services including OpenAI, Google, Apple, and AWS. Your use of these third-party services is subject to their respective terms of service and privacy policies. WikiMoi is not responsible for the practices of third-party services.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

• WikiMoi provides the Service "as is" and "as available" without warranties of any kind, either express or implied.
• WikiMoi shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.
• WikiMoi's total liability for any claims arising from or related to these Terms or the Service shall not exceed the amount you have paid to WikiMoi in the 12 months preceding the claim.
• WikiMoi is not liable for the accuracy of AI-generated content or any damages arising from reliance on such content.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.

11. Account Termination

11.1 Termination by You

You may delete your account at any time through the app or website settings. Upon deletion, your profile, biography, and associated data will be removed in accordance with our Privacy Policy.

11.2 Termination by WikiMoi

We may suspend or terminate your account if you:

• Violate these Terms or any applicable laws
• Engage in fraudulent or abusive behavior
• Create content that is harmful, offensive, or violates the rights of others
• Remain inactive for an extended period (we will notify you before termination in this case)

In the event of termination, we will provide you with reasonable notice unless immediate termination is necessary to prevent harm or comply with legal requirements.

12. Indemnification

You agree to indemnify and hold harmless WikiMoi, its officers, directors, employees, and agents from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms.

13. Dispute Resolution

We encourage you to contact us first at contact@wikimoi.com to resolve any disputes informally. If a dispute cannot be resolved informally, you agree that the dispute will be subject to the jurisdiction of the courts of Berlin, Germany. The European Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions. Mandatory consumer protection laws of your country of residence shall apply where applicable.

15. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting a notice on our website or sending you an email at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the modified Terms.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
